Cita:Sentencia[/url]"]By its judgment delivered today, the Court explains that the principle of exhaustion of the distribution right applies not only where the copyright holder markets copies of his software on a material medium (CD-ROM or DVD) but also where he distributes them by means of downloads from his website.
Where the copyright holder makes available to his customer a copy ÔÇô tangible or intangible ÔÇô and at the same time concludes, in return form payment of a fee, a licence agreement granting the customer the right to use that copy for an unlimited period, that rightholder sells the copy to the customer and thus exhausts his exclusive distribution right. Such a transaction involves a transfer of the right of ownership of the copy. Therefore, even if the licence agreement prohibits a further transfer, the rightholder can no longer oppose the resale of that copy. (...)
Moreover, the exhaustion of the distribution right extends to the copy of the computer program sold as corrected and updated by the copyright holder. (...)
Therefore the new acquirer of the user licence, such as a customer of UsedSoft, may, as a lawful acquirer of the corrected and updated copy of the computer program concerned, download that copy from the copyright holderÔÇÖs website.
Cuando el propietario del cpyright hace disponible a su cliente una copia - tangible o intangible - y al mismo tiempo incluye, en retorno del pago de una cantidad, una licencia de uso permitiendo al usuario el uso de la copia por un periodo ilimitado de teimpo, el poseedor de los derechos vende su copia al cliente y así finalizan sus derechos de distribución en exclusiva. Esta transacción conlleva la transferencia de la propiedad de la copia. Por consiguiente, incluso si la licencia de uso prohibe futuras transferencias, el poseedor de los derechos no puede oponerse a la reventa de su copia.
